CDL Holders

Special rules apply to Commercial Driver’s License (CDL) holders. If you are a CDL holder at the time you are cited for a DUII, you will be ineligible for the Diversion program, even if you were driving your personal vehicle at the time of the arrest.

If you are driving a commercial vehicle with a BAC of .04 or greater, you are subject to a minimum one year suspension of your CDL by the Department of Motor Vehicles. This is an administrative suspension only and does not alter the legal limit for criminal convictions. The following table outlines the suspension periods for a commercial driver’s license when the CDL holder was driving a commercial vehicle at the time of the stop or arrest.

CDL holders who are convicted of a DUII committed while driving a commercial vehicle face a one year suspension of their CDL for their first conviction and a lifetime suspension of their CDL for all subsequent convictions. If the CDL holder was transporting hazardous material at the time of the arrest the suspension period for a first conviction is increased to three years. This suspension is in addition to any suspension the CDL holder would normally receive for a DUII conviction.
